HARRISBURG, Pa. — A Pennsylvania superior court Tuesday rejected a 25-year-old precedent against gay parents seeking custody, the TimesLeader.com reported.

The original precedent made a parent’s sexual orientation a variable in determining custody, according to the article.

Judge Christine Donohue wrote the opinion, which described the precedent as being founded on prejudice and unsupported theories “that the sexual orientation of a parent will have an adverse effect on the child, and that the traditional heterosexual household is superior to that of the household of a parent involved in a same sex relationship.”
