The marriage of a lesbian couple in Massachusetts in 2004 is now the focus of the Texas court system as the couple is filing for divorce, an issue many same-sex couples will face if they wish to separate while living in a state that doesn't recognize gay marriage.

The marriage of a lesbian couple in Massachusetts in 2004 is now the focus of the Texas court system as the couple is filing for divorce, an issue many same-sex couples will face if they wish to separate while living in a state that doesn’t recognize gay marriage.

After they married, Angelique Naylor and Sabina Daly moved to Texas, a state that does not recognize same-sex marriage. Because the state law defines marriage as between a man and a woman, it won’t recognize a same-sex divorce.

Texas Attorney General Greg Abbott said the only option the couple has is to void their marriage. Through legal voidance, “the parties can achieve a legal termination of their Massachusetts marriage, through an enforceable judgment,” he explained.
